General Terms and Conditions of Eccasion

These terms and conditions apply to all products and services offered by Eccasion (hereinafter referred to as "we," "us," or "our"). By using our services or products, you agree to these terms and conditions.

Eccasion is a trade name of the company Eccasion Nederland B.V.

1. Definitions

  • Customer: The natural person or legal entity that enters into an agreement with Eccasion.
  • Product: Electric vehicles or related products and services sold or offered by Eccasion.
  • Agreement: The agreement between the customer and Eccasion regarding the supply of products or services.

2. Applicability

These general terms and conditions apply to all offers, quotations, orders and agreements between Eccasion and the customer, unless otherwise agreed in writing.

3. Offers and Quotations.

  • All offers and quotations of Eccasion are without obligation and have a validity period of 5 days from the date of offer or quotation, unless otherwise indicated.
  • Eccasion reserves the right to withdraw or modify offers or quotations without giving reasons before the customer has accepted them.

4. Orders and Agreement

  • An agreement is established once the customer agrees to bid on an offered product and Eccasion has confirmed this agreement in writing or electronically.
  • Once the customer agrees to purchase a vehicle, payment of the 25% over the full amount must be made within 2 days of this agreement in order for Eccasion to bid on the vehicle. Only when the amount is received will Eccasion bid on the offered product.
  • The customer must provide correct and complete information regarding the desired specifications of the vehicle. When the purchased vehicle meets the provided photos and agreed upon specifications shared in advance, this is considered full delivery of the product.
  • Until the earlier of (a) 2 weeks after delivery or (b) 500 kilometers of use, technical inspection is applicable. Should the customer identify a technical defect not known in advance during this period, Eccasion will have it repaired free of charge by a party of Eccasion's choice, unless this technical defect is attributable to the customer (for example, due to driving behavior or having the customer tinker with the car himself or herself during this period) then this right to repair does not apply.
  • If the customer wishes to return the car due to an undisclosed technical defect, in the 2 week period after delivery (or within 500 kilometers), this is possible and the customer will receive 100% of the purchase price back, unless this technical defect is due to the customer (for example, due to driving behavior or tinkering with the car yourself (or having it tinkered with) during this period) then this right of repurchase does not apply. However, Eccasion reserves the right to charge for any damage caused to the vehicle after delivery.
  • Customer can dissolve the agreement regarding the purchase during a cooling-off period of 14 days (or up to 500 kilometers) without giving any reason. The cooling-off period starts from the day after the customer receives the purchase. The customer can make use of the cooling-off period by means of an unambiguous statement, to be sent by mail or e-mail. The model form that can be downloaded via this link can be used for this purpose.

5. Prices and Payments

  • The stated prices include VAT and other taxes, unless otherwise indicated.
  • Payment must be made within the indicated payment term as stated on the invoice. In case of late payment, Eccasion reserves the right to charge statutory interest and any collection costs.
  • Until the time of full payment, Eccasion reserves the right to suspend its obligations under the agreement.
  • We only offer digital payment methods (cash is not accepted).

6. Delivery and Transfer of Risk

  • The delivery time is reasonably determined, but is indicative. Exceeding the delivery time does not entitle the customer to compensation or dissolution of the agreement, unless otherwise agreed.
  • The risk of loss, damage or defect of the vehicle is transferred to the customer at the time the vehicle is delivered to the agreed delivery address.
  • From the moment of delivery, the customer is fully responsible for the vehicle. The customer is responsible for maintenance, insurance and ensuring that the vehicle remains safe and in good condition.

7. Warranty and Maintenance

  • Eccasion is not liable for statements made by third parties regarding a product.
  • Depending on the age and mileage there may still be factory warranty on the vehicle. Manufacturer's warranty must be claimed directly from the manufacturer. Eccasion has and takes no role in or responsibility for this.
  • Eccasion offers an optional additional warranty for the battery of electric vehicles. The exact terms of this warranty will be provided separately.
  • Any defects that arise and fall within the legal warranty will be repaired free of charge. Eccasion reserves the right to take back the vehicle against refund of the full purchase price if the repair costs exceed the purchase price.
  • After delivery, it is the customer's responsibility to properly maintain the vehicle and perform timely service checks to ensure the safety and performance of the vehicle.

8. Liability

  • Eccasion is not liable for indirect damages, consequential damages or lost profits. Our liability for damages is limited to the amount paid by the customer for the vehicle or service in question.
  • Eccasion is not liable for any technical problems or defects that occur outside of those covered within the legal warranty.

9. Force Majeure

  • In the event of force majeure, which is defined as disruptions in delivery, strikes, pandemics, or other unforeseen circumstances, Eccasion has the right to terminate or suspend the agreement without being obliged to pay compensation.
  • The amount paid in advance will be refunded in case of force majeure, unless the customer has explicitly agreed to the purchase and the product meets the agreed specifications.

10. Privacy and Data Processing

11. Disputes

  • All agreements and these terms and conditions are governed by Dutch law.
  • Disputes arising from or related to the agreement shall be submitted to the competent court where Eccasion is located.

12. Changes to the General Terms and Conditions.

  • Eccasion reserves the right to modify these general terms and conditions. Amendments are published on our website and are effective from the date of publication. It is the customer's responsibility to remain informed of the applicable terms and conditions.
